Offences against the Forces

▲ Proclamation to take provision for the safety of the British and Allied Forces and for the maintenance of public order and safety.

General Officer Commanding Military Forces, Malaya, in exercise of the authority conferred upon me by the Supreme Allied Commander, South East Asia Command, DO HEREBY PROCLIJ AND ORDER

This Proclamation may be cited as the Offences against the Forces Proclamation.

In this Proclamation

"Forces" means the British and Allied Naval, Land and Air Forces and any part or member thereof, and any person employed by, or in the service of, or who is a follower of, or who accompanies any part of, any such Forces;

"person" includes all persons except members of the Forces and persons who, if captured, are entitled to be treated as prisoners of war.

Any person who

(a) bears arms against the Forces; or

(b) ccts as an enemy spy or knowingly harbours or aids

in any way an enemy spy; or

(c) communicates in any matter whatsover with the

enemy or with any one within territory under enemy control on any matter whatsover with intent directly or indirectly to assist the enemy or to prejudice public safety or the efficient prosecution of the war; or

(d) wilfully misleads any member of the Forces in the

performance of his duties; or

(e) knowingly assist any member of the enemy armed

forces to evade capture; or

(f) knowingly assists a prisoner of war to escape or knowingly harbours or conceals any escaped prisoner of war or gives any escaped prisoner of war any assistance with intent thereby to prevent, hinder or interfere with his apprehension; or

(g) destroys, damages, removes or tampers with any war

material belonging to the Forces with intent thereby to interfere with military operations or to prejudice the safety of the Forces;

or

(h) wilfilly destroys, damages, interferes with or

intercepts communications by mail, courier, telegraph, telephone, cable, radio or otherwise;
